Entry in the register of entities, if they are waste producers.

The Environmental Protection and Health and Safety Department of the Szczecin and Świnoujście Seaports Authority informs all Lessees and Lessees of port areas and facilities about:

the need to make an entry in the register of entities introducing products, packaged products and waste management, if they are waste producers obliged to keep records of waste, with the exception of waste holders listed in art. 51 sec. 1 points 1 and 2 of the Act on waste (the holder of waste who has obtained an integrated permit and the holder of waste who has obtained a permit to generate waste). The above register is an integral part of the Database on products, packaging and waste management (BDO) kept by the voivodship marshal.

Pursuant to Art. 50 sec. 2 and paragraph 3 of the Waste Act (Journal of Laws of 2018, item 992, i.e.) activities

in the field of waste production (in the case of a waste producer obliged to keep their records), may only be carried out by an entity entered in the register, and the entry in the register must be obtained prior to commencing operations in the indicated scope.

They are excluded from keeping records of waste, in accordance with art. 66 sec. 4 of the Waste Act:

1) manufacturers:

a) municipal waste,

b) waste in the form of end-of-life vehicles, if these vehicles have been transferred to an entrepreneur operating a disassembly station or an entrepreneur operating a vehicle collection point;

2) natural persons and organizational units that are not entrepreneurs and use waste for their own needs,

3) entities referred to in Art. 45 sec. 1 point 1 of the Act on waste (non-professional collectors),

4) types of waste or the amount of waste specified in the regulations issued on the basis of art. 66 sec. 5 of the Waste Act.

If the entity does not meet the above exemptions and is not released

from the obligation to keep records (in accordance with the ordinance of the Minister of the Environment

of 12/12/2014 on the types of waste and the amount of waste, for which there is no obligation to keep records of waste, Journal Of Laws of 2015, item 1431), should submit an application to the marshal of the province, competent for the seat of the entity, for entry in the register.

At the same time, we would like to inform you that the Act on waste (Art. 179) provides for a criminal sanction

in the form of an arrest or a fine if the entity fails to submit an application for entry in the register. In turn, art. 194 paragraph. 1, point 5) of the Waste Act provides for a fine for an entrepreneur who conducts business, inter alia, in the field of waste production without the required entry in the register. An administrative fine for violation may not be less than PLN 5,000 and may not exceed PLN 1,000,000.
